Terms of Service

Welcome to AdWizards AI LLC ("AdWizards," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Services Description

AdWizards AI LLC provides AI-powered creative production services with human curation, including:

• Ad Creation: Animated, static, and UGC-style ads, plus Studio-Grade Productions (depending on plan)
• Creative Strategy: Brief development and scripting services
• Platform Optimization: Ads optimized for Meta, TikTok, YouTube, and other platforms
• Quality Control: Human-curated editing and QC checks

2. Service Plans

Starter Plan (USD 3,500/month)

• You write the brief and script — we handle production
• 1 Angle active at a time
• Studio-Grade Productions not included
• Production cycles of 48–72 hours
• Each Angle ships with testing Variants (alternate hooks/openings/thumbnails)
• QC Guarantee: spelling/logo/export issues replaced within 48h at no cost

Core Plan (USD 5,500/month)

• Everything in Starter included
• We write the brief and script (or you can if you prefer)
• 2 Angles active simultaneously
• 1 Studio-Grade Production per month included
• Iterations twice per week
• Slack/WhatsApp support with ≤24h response on business days

Performance Lab Plan (USD 8,500/month)

• Everything in Core included
• 3 Angles active simultaneously with prioritized backlog
• Weekly creative report (CTR, Hook Rate, CPC/CPM, watch-through)
• 2 Studio-Grade Productions per month: cinematic productions with 2–3 week timelines
• Testing plan and strategic recommendations

Enterprise & Agencies (Custom)

• Custom negotiated contract with pricing based on scope
• White-label delivery available for agencies
• Custom SLAs and support terms
• Enterprise and agency plans are governed by their individual agreements; where an individual agreement conflicts with these Terms, the individual agreement prevails

Studio-Grade Productions

• Allocation: Core includes 1 Studio-Grade Production per month; Performance Lab includes 2 per month. Unused allocations do not roll over to the next month
• Pause Rule: While a Studio-Grade Production is in production, your plan's active performance Angles are paused — Studio-Grade Productions and Angles never run in parallel. Angles resume once the Studio-Grade Production is delivered
• Commitment: A Studio-Grade Production may be canceled or rescheduled at no cost until storyboard approval. After storyboard approval, the production is committed and non-refundable

3. Payment Terms

• Monthly Plans: Billed monthly in advance. Monthly subscriptions renew automatically at the start of each billing cycle until canceled by emailing hello@adwizards.ai
• Annual Billing: Annual plans are billed upfront for 12 months at a 15% discount. Cancellation stops the next renewal; no refund is provided for the remaining term
• Payment Method: All payments processed securely through Stripe
• Currency: All prices in USD
• Late Payment: Services may be paused for accounts with outstanding balances

4. Delivery Policy

• Turnaround: Performance Angles delivered in 48–72 hours from brief approval; Studio-Grade Productions require 2–3 week timelines
• Formats: MP4 files in 9:16, 1:1, and 16:9 aspect ratios
• Revisions: Revision cycles of 48 hours on all plans; iterations twice per week on Core and Performance Lab
• Source Files: Available upon request (included in all plans)

5. QC Guarantee

We perform strict quality checks on all deliverables, including:

• Spelling and grammar
• Logo usage and brand compliance
• Legal copy and disclaimers
• Safe zones and platform requirements

Guarantee: If a delivery includes a QC issue (spelling error, logo misuse, export error), we will replace it within 48 hours at no additional cost.

6. Refund Policy

For complete details about our refund and cancellation policies, please see our dedicated Refund Policy page. Summary:

• Production Cycles: Full refund if you cancel before production begins on your current cycle's brief, (deadline misses are credited, not refunded). No refunds after first draft delivery.
• Monthly Subscriptions: Cancel anytime. No refunds for the current billing period. Service continues until the end of the paid period.
• Studio-Grade Productions: Cancellable or reschedulable at no cost until storyboard approval; committed and non-refundable after storyboard approval. Unused monthly allocations do not roll over.
• Quality Issues: If we fail to meet QC standards, we will re-deliver at no cost rather than issuing a refund.

7. Cancellation Policy

• Monthly Subscriptions: Cancel at any time. Cancellation takes effect at the end of the current billing cycle
• Annual Plans: Cancellation stops the upcoming renewal; service continues until the end of the paid 12-month term with no refund of the remaining term
• Studio-Grade Productions: May be canceled or rescheduled at no cost until storyboard approval; after storyboard approval the production is committed for that cycle

8. Intellectual Property

• Ownership: You own all delivered creative assets upon full payment
• Usage Rights: You receive full commercial usage rights for all delivered ads
• Portfolio Use: AdWizards may use delivered work in portfolios and case studies unless otherwise agreed
• Client Materials: You grant us a license to use your brand materials solely for creating your ads

9. Client Responsibilities

You agree to:

• Provide clear briefs, brand guidelines, and necessary assets
• Respond to revision requests within reasonable timeframes
• Ensure you have rights to any materials provided to us
• Comply with platform advertising policies when using our ads

10. Limitation of Liability

AdWizards is not responsible for:

• Ad performance or results (CTR, conversions, ROAS, etc.)
• Platform rejections due to policy violations in client-provided content
• Delays caused by client feedback or approval timelines
• Third-party platform changes or algorithm updates

Our total liability shall not exceed the amount paid for the specific service in question.

11. Confidentiality

We will keep your project details, business information, and creative assets confidential. We will not share them with third parties except as necessary to deliver services.

12. Prohibited Uses

You may not use our services for:

• Illegal activities or products
• Misleading or fraudulent advertising
• Content that violates platform policies
• Hate speech, discrimination, or harmful content

13. Modifications to Terms

We may update these Terms from time to time. We will notify active clients of material changes. Continued use of our services constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States. Any disputes will be resolved in the state or federal courts located in Bernalillo County, New Mexico.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AdWizards AI LLC regarding our services.
